3. Applicable law
German law applies exclusively, including mandatory EU consumer protection provisions. The CISG does not apply.
4. Tickets, contract formation, delivery
4.1 Contract formation
By completing checkout, you submit a binding offer. The contract is concluded when we confirm (for example by email) or when the ticket is made available.
4.2 Our ticketing system and payment via PayPal
We operate our own ticketing system. Payment processing is carried out via PayPal. We do not store full credit card details, card numbers, or CVV data.
4.3 Ticket validity
Tickets are valid only for the event and date stated on the ticket. Ticket IDs and QR codes are unique and typically single use. Duplication, manipulation, or attempted multiple use invalidates the ticket.
4.4 Transfer and resale
Commercial resale, auctioning, use for raffles, or promotional use without prior written consent is prohibited. We may block tickets and refuse admission in case of violations.
5. Admission, age restrictions, ID checks
5.1 Youth protection
Admission of minors is prohibited unless the specific event is expressly intended for the relevant age group. Applicable youth protection rules and any official requirements apply.
5.2 ID checks
We may require a valid official photo ID. Admission may be refused if ID is not provided or if there are justified doubts.
5.3 No entitlement to admission
There is no entitlement to admission, especially in cases of violations of these rules, security concerns, aggressive behavior, harassment, discriminatory conduct, or apparent severe intoxication by alcohol or drugs. In such cases, refunds are generally excluded unless mandatory legal provisions require otherwise.
6. House rights and security measures
We exercise house rights. Instructions from staff and security must be followed. Security checks (for example bag checks) may be conducted to the extent permitted by law. Prohibited items may be confiscated.
7. Prohibited conduct, sanctions, reporting to authorities
7.1 Prohibited conduct
In particular, the following is prohibited:
- criminal acts or attempted criminal acts (including theft, assault, fraud, property damage, threats, coercion, trespass),
- possession, trade, use, or distribution of illegal narcotics where prohibited by applicable law,
- carrying or using weapons or dangerous objects,
- sexual harassment, stalking, discrimination, incitement, extremist content,
- manipulation of tickets, entry systems, or security measures,
- unauthorized photo, video, or audio recording, especially if third-party rights are infringed.
7.2 Sanctions
In case of violations, we may:
- refuse admission or remove persons from the premises,
- issue a ban from the premises, including permanent bans,
- pursue civil claims, including damages under statutory rules,
- contact police or authorities and file reports.
8. Damage in the venue, guest liability
Anyone who causes damage to inventory, equipment, building, or facilities is liable under statutory provisions. This may include cleaning and restoration costs and consequential damages to the extent permitted by law.
9. Health and personal responsibility
Attendance is at your own risk. Events may include loud music, lighting and strobe effects, crowds, and alcohol service.
If you have health limitations (for example cardiovascular conditions, epilepsy, pregnancy), we strongly recommend seeking medical advice in advance and coordinating with club management if needed. Flinsch Club is not responsible for health incidents resulting from a failure to take reasonable personal precautions, to the extent permitted by law.
10. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body, or health.
In cases of slight negligence involving essential contractual obligations, liability is limited to the typical, foreseeable damage.
Otherwise, liability is excluded to the extent permitted by law.
11. Program changes
We reserve the right to make reasonable changes to schedule, line-up, or organization provided the overall character of the event is not materially affected.
12. Severability and jurisdiction
If any provision is invalid, the remaining provisions remain effective.
For merchants and comparable entities, Frankfurt am Main is the place of jurisdiction. For consumers, statutory jurisdiction rules apply.
